Privacy statement BV TECH8 

1 - General


The BV Tech8 (KBO 0776.621.491 and VAT no. BE0776.621.491), hereinafter referred to as 'BV Tech8', is a company incorporated under Belgian law in the form of a private limited company and with its registered office at 2220 HEIST-OP-DEN - BERG, Zonderschotsesteenweg 2 B.

BV Tech8 aims to carry out computer consultancy activities, in the broadest sense of the word. This purpose includes, but is not limited to:


- providing advice, making designs, installing and supporting and supervising projects in information and communication technology (ICT);

- organizing helpdesk and control center and providing remote advice;

- analyzing ICT systems, installing and maintaining software applications, delegation of specialized hard and software personnel;

- the purchase and sale, rental, leasing and installation of computer hardware and software and all associated peripherals and accessories;

- design and furnishing of computer rooms and purchase and sale of specialized furniture;

- organizing all possible seminars, training courses or events, either in groups or individually;

- programming and designing computer programs.



In the context of the exercise of the aforementioned purpose, BV Tech8 processes personal data as shown in this privacy statement.

Your trust – and therefore your privacy – is of the utmost importance to us. Please read this Privacy Statement very carefully. It explains why and how we as “controller” collect your personal data, how we protect it and for how long we keep it. We keep your data as safe as reasonably possible and protect it against loss and unauthorized disclosure or access and we handle your personal data in strict compliance with applicable data protection laws, in particular the General Data Protection Regulation 2016/679 of 27 April 2016 (" GDPR').

This Privacy Policy is an integral part of our Terms and Conditions.

2 – What is personal data and what personal data does it concern?

Personal data must be interpreted very broadly and can be described as any information that, directly or indirectly, allows you to be identified as a natural person. In concrete terms, this could include your name, address details, e-mail, photos, telephone number, location details, but also details about your assets, professional activities, etc.

The information about legal persons, on the other hand, does not fall under the concept of 'personal data'.

The limited personal data we hold is collected in the following ways:

- We obtain some of this data directly from you in the context of our business relationship when you contact us.

- We receive other data from third parties, such as other advisers you work with.

- We can also obtain certain personal data through our marketing: especially if you give us explicit permission for this, we process your full name and e-mail address for sending direct marketing, newsletters, actions and promotions regarding our products and services. You can always easily unsubscribe from this.

BV Tech8 processes personal data because you use our services and/or because you (have) provided this personal data to us yourself or because we have obtained it from third parties.

The personal data that is usually collected by us are:

• Name;

• Birthdate and place;

• National Insurance number;

• Address data;

• Phone number;

• E-mail address;

• IP address;

• Bank account number, and

• Other personal data that you have actively provided to BV Tech8 in the context of your assignment (eg financial data, information regarding your ICT system, data relating to your profession, family data, etc.).


BV Tech8 does not intend to collect data from persons under the age of 18, unless with the permission of their parents or guardian. If you believe that BV Tech8 has collected personal information about a minor without the required consent, please contact us at stephan@tech8.be and this information will be deleted.

Although you are never obliged to disclose personal data, a refusal to provide necessary information may (seriously) impede or make it impossible to provide our services.


3. For what purpose, on what basis and for how long are the personal data processed?


Personal data is collected by BV Tech8 on the basis of various grounds, including depending on your relationship with BV Tech8.

Personal data is processed by us in the context of our general customer and order management, or to provide our services. This includes, but is not limited to, customer administration, following up orders and deliveries, performing the requested services, invoicing, answering questions, and for marketing purposes.

The processing is based on the following categories of legal bases:

First of all, your personal data will be processed on the basis of the permission you have granted, including when you subscribe to newsletters sent by BV Tech8. This data will be kept and used by BV Tech8 until (i) the moment you withdraw your consent – ​​which can happen at any time by means of a simple notification to the (email) address mentioned above – or (ii) the moment upon which BV Tech8 notices that the data in question is no longer correct. Insofar as the processing of personal data takes place on the basis of your explicit consent, you always have the right to withdraw the consent given.

Furthermore, your personal data can also be processed if necessary for the execution of the agreement between BV Tech8 and the customer, supplier or employee involved. This data will be kept for the duration of the collaboration and after the end of the collaboration during the period that any of the contracting parties (BV Tech8 or the co-contracting party involved) can institute legal proceedings against the other contracting party. To the extent that your personal data is contained in accounting data, it will be retained for the retention periods prescribed by law.

The processing of certain personal data also takes place to comply with the legal obligations that rest on BV Tech8. This personal data will be kept for the legally prescribed retention periods.

Finally, personal data is also processed on the basis of necessity for the protection of the legitimate interest of BV Tech8, such as, among other things, that of sending announcements or messages in the context of maintaining the customer relationship. Data collected on this basis will be retained for up to seven years after the end of the last contractual relationship, unless the data subject objects to the retention earlier.

Data relating to applicants will be kept until the end of the second calendar year following the date of receipt of such data, for the purpose of evaluating the application as well as for the purpose of establishing a recruiting reserve.

After the retention period has expired, we will ensure that your data is securely deleted or destroyed.


4. Who will have access to my personal data?

Within the organization of BV Tech8, your personal data can, if this is necessary for the realization of the intended purposes, be communicated to the employees involved and the personnel of BV Tech8. We may also share your personal data with our professional partners if necessary for the realization of the intended purposes. We ask these partners to take the necessary technical and organizational measures to protect your personal data. They must respect the confidential nature of this data and may only use this data in accordance with BV Tech8's instructions.

BV Tech8 does not sell your data to third parties. However, in the context of a possible reorganization, bankruptcy or transfer of the activities of Tech8 BV, data that is part of our business activities may be transferred to third parties.

Personal data of suppliers or employees may also be communicated to government authorities, including in the context of deductions or withholding taxes of a fiscal or parafiscal nature. Specifically for personal data of employees, this is also shared with external contractors (such as the social secretariat or external prevention service) whose intervention is necessary for a smooth settlement of the contractual relationship.

In limited cases, we may also be required to share personal data based on a court order or mandatory law.


5. Automated Decision Making

Automated decision-making is defined as decisions about individuals that are based solely on automated data processing and that produce legal effects or significantly affect the individuals concerned.

BV Tech8 does not use automated decision-making as described above.


6. What rights do you have with regard to the processing of your personal data?


In principle, you have the right to view your personal data, to correct it if it is incorrect or incomplete, or to delete it. You also have the right to have the processing of your personal data restricted.

You also have the right to withdraw your consent to the data processing or to object to the processing of your personal data by BV Tech8.

You also have the right to data portability, which means that you can submit a request to BV Tech8 to send your personal data that we have in a computer file to you or another organization mentioned by you.

You can send a request for access, correction, deletion, restriction of processing, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to us by post or by e-mail to stephan@tech8. be. BV Tech8 strives to respond as quickly as possible, but in any case within thirty days, at your request.


For the sake of completeness, it should be underlined that the aforementioned rights are subject to a number of exceptions.


For example, BV Tech8 will not be obliged to comply with your request for inspection, correction, deletion, restriction of processing or transfer because of our legal obligations, reasons of public interest, for the establishment, exercise or substantiation of a legal claim or the legitimate exercise of the right to freedom of expression and/or information.

Finally, if you believe that BV Tech8 has not acted in accordance with data protection legislation, you have the right to submit a complaint to the national supervisory authority. This can be done via the following contact details:

7. Security

To guarantee the security of your personal data, we apply at least the usual technical and organizational security measures that can reasonably be expected of us to protect your personal data against destruction, loss, alteration, falsification, distribution or unauthorized access.

Personal data will only be transferred to a partner in a country outside the European Economic Area if that country guarantees an adequate level of protection for your personal data. Before sharing personal data with a partner in the United States of America, we require a separate processing agreement or certification under the Privacy Shield Framework (www.privacyshield.gov).

We cannot be held liable for incorrect or unlawful use of personal data by a third party. You also remain responsible for the confidentiality and use of your computer, IP address, login and identification data.

8. Changes

BV Tech8 reserves the right to change this Privacy Statement from time to time, within the limits of applicable privacy and data protection regulations. Changes will be notified to you via the website or via e-mail.
